Our Services may include membership, lifestyle management, luxury travel planning, hotels and villas, private aviation and yacht coordination, ground transportation, dining, experiences and events, sports and entertainment access, wellness coordination, corporate hospitality, and family office support.
Unless expressly stated otherwise in writing, Privé acts as an advisor, coordinator, facilitator, booking intermediary, or agent in arranging services provided by independent third parties.
2. Eligibility & Account Information
- You must be at least eighteen (18) years old and legally capable of entering into binding agreements to use our Services.
- You agree to provide accurate, complete, and current information and to maintain valid contact and payment information when required.
- If you request Services on behalf of another individual, household, business, trust, family office, or other organization, you represent that you have authority to do so.
- Privé reserves the right to accept, decline, suspend, or discontinue Services as permitted by applicable law and any governing Membership Agreement.
3. Membership
- Certain Privé Services require an active membership.
- Membership levels, joining fees, annual dues, term lengths, benefits, renewal provisions, and other membership-specific conditions are governed by the applicable Membership Agreement or membership offer presented at enrollment.
- Membership provides access to Privé’s service platform and applicable benefits. It does not guarantee the availability of any particular hotel, residence, flight, aircraft, yacht, restaurant, event, ticket, experience, product, supplier, reservation, upgrade, amenity, or preferred rate.
- Unless otherwise stated in the applicable Membership Agreement, membership fees are non-refundable and non-transferable.
4. Service Requests & Availability
- Privé will use commercially reasonable efforts to fulfill Member requests but cannot guarantee that every request can be accommodated.
- Availability, pricing, timing, access, inventory, and fulfillment may depend upon third-party suppliers and circumstances outside Privé’s control.
- Quotations and proposals are subject to availability and are not confirmed until the applicable reservation or transaction has been accepted and any required payment or authorization has been received.
5. Independent Suppliers
- Many Services arranged through Privé are provided by independent third parties.
- These may include hotels, resorts, airlines, aircraft operators, charter brokers, yacht operators, villa owners and managers, transportation companies, restaurants, ticket providers, tour operators, event organizers, wellness providers, guides, and other suppliers.
- Unless expressly stated otherwise, Privé does not own, operate, manage, supervise, or control these suppliers.
- Each supplier is independently responsible for its operations, personnel, licensing, regulatory compliance, insurance, safety standards, products, services, and performance.
- Supplier-specific terms and conditions may apply in addition to these Terms.
6. Pricing, Fees & Payments
- Prices may be subject to availability, taxes, exchange rates, supplier surcharges, service charges, destination fees, fuel charges, and other applicable costs.
- Pricing may change until a reservation or transaction is confirmed.
- By approving a transaction, you authorize Privé and, where applicable, the relevant supplier or payment processor to charge the approved payment method for applicable membership fees, travel deposits, supplier balances, service fees, planning fees, cancellation fees, and other approved charges.
- Privé may require full or partial payment before confirming certain Services.
7. Cancellations, Changes & Refunds
- Cancellation and modification policies vary by supplier and transaction.
- You are responsible for reviewing applicable cancellation terms before approving a booking.
- Supplier cancellation penalties, non-refundable deposits, change fees, and other restrictions may apply.
- Privé planning, consulting, itinerary design, management, and service fees are non-refundable once the applicable work has commenced unless otherwise agreed in writing.
- Any supplier refund remains subject to the supplier’s terms and Privé cannot guarantee the timing or approval of a third-party refund.
8. Travel Documentation & Entry Requirements
- Members are responsible for ensuring that they and their traveling parties possess all documentation necessary for travel, including valid passports, visas, permits, vaccinations, health documentation, immigration documentation, and any other required authorizations.
- Government entry requirements can change without notice.
- Privé is not responsible for denied boarding, denied entry, delays, penalties, or other losses resulting from a traveler’s failure to satisfy applicable requirements.
9. Travel Insurance
- Privé strongly recommends that Members obtain appropriate travel insurance based upon the nature and value of their travel arrangements.
- Coverage may include trip cancellation, trip interruption, medical expenses, emergency evacuation, baggage loss, supplier default, and other risks.
- Insurance products are subject exclusively to the terms, exclusions, limits, and conditions of the applicable insurer.
10. Privacy, Confidentiality & Discretion
- Privacy and discretion are fundamental to the Privé member experience.
- Privé recognizes that Members may include executives, entrepreneurs, professional athletes, entertainers, public figures, family offices, and other individuals and organizations requiring heightened confidentiality.
- Privé will use commercially reasonable measures to protect non-public Member information, including identity, contact information, travel plans, preferences, household information, and confidential business information.
- Privé may disclose information when reasonably necessary to fulfill a Member request, process a transaction, coordinate with an authorized representative or supplier, protect Privé or its Members, comply with applicable law, respond to lawful governmental requests, or enforce an agreement.
- Third-party suppliers may receive information reasonably necessary to provide the requested Services.
- Additional information regarding our collection, use, retention, and protection of personal information is provided in our Privacy Policy.
11. Member Conduct & Mutual Respect
- Privé expects Members, employees, representatives, partners, and suppliers to interact professionally and respectfully.
- Members may not use Privé Services for unlawful, fraudulent, abusive, threatening, harassing, or deceptive purposes.
- Neither Privé nor a Member shall knowingly publish or communicate materially false or defamatory statements regarding the other.
- Nothing in this provision restricts truthful statements, legally protected communications, regulatory reporting, testimony, legal claims, or disclosures required by law.
- Privé may suspend or terminate Services in response to unlawful activity, fraud, threats, harassment, abuse, misuse of Privé Services, or other material violations of these Terms.
12. High-Risk Activities & Assumption of Risk
- Certain activities arranged or coordinated through Privé involve inherent and potentially significant risks.
- These may include private aviation, helicopter transportation or excursions, yachting, boating, skiing, heli-skiing, scuba diving, water sports, mountaineering, safaris, wildlife encounters, motorsports, adventure travel, remote expeditions, and similar activities.
- By choosing to participate, you acknowledge that such activities may involve risks of accident, illness, serious bodily injury, permanent disability, property loss, evacuation, or death.
- Participation is voluntary, and Members are responsible for evaluating their personal circumstances, physical capabilities, insurance coverage, and willingness to assume the risks associated with an activity.
- Privé strongly recommends appropriate medical, travel, evacuation, and specialty insurance when participating in high-risk activities.
- Nothing in these Terms excludes liability that cannot lawfully be excluded.
13. Private Aviation, Helicopters & Other Transportation
- Unless expressly stated otherwise in writing, Privé is not an aircraft operator, air carrier, helicopter operator, motor carrier, or transportation provider.
- Privé may assist Members in identifying, coordinating, or booking transportation through independent operators, brokers, or suppliers.
- The applicable operator retains operational control and responsibility for aircraft, vehicles, crews, maintenance, regulatory compliance, safety, routing, weather determinations, and the operation of the transportation service.
- Schedules, aircraft, routes, crews, and departure times may change because of weather, mechanical issues, operational requirements, governmental restrictions, or other circumstances.
14. Luxury Assets
- Unless expressly stated otherwise in writing, Privé does not own, operate, maintain, manage, or control aircraft, helicopters, yachts, villas, private residences, luxury vehicles, hotels, restaurants, transportation fleets, event venues, or other third-party luxury assets offered or arranged through the Services.
- The applicable owner, operator, manager, or supplier remains responsible for the asset and its operation.
15. Corporate, Family Office & Authorized Representatives
- Where Services are requested on behalf of a corporation, family office, trust, partnership, management company, investment office, household, athlete, entertainer, executive, or another individual or organization, the person submitting the request represents that they possess appropriate authority to act on behalf of the applicable party.
- This authority may include approving bookings, accepting supplier terms, authorizing expenditures, executing agreements, and authorizing payment.
- Privé may reasonably rely upon instructions from authorized representatives until notified otherwise.
- The applicable client or organization remains responsible for properly authorized charges incurred on its behalf.
16. Electronic Instructions & Approvals
- Members may communicate with Privé through email, SMS, telephone, electronic signature platforms, approved messaging services, member portals, applications, or other mutually accepted channels.
- Where permitted by law, approvals and instructions transmitted through these channels may constitute binding authorization for bookings, purchases, payments, itinerary approvals, modifications, cancellations, and other transactions.
- Privé may reasonably rely upon communications that appear to originate from a Member or an authorized representative unless Privé has actual knowledge that the communication is unauthorized or fraudulent.
17. Cybersecurity, Fraud & Payment Instructions
- Electronic communications and financial transactions are subject to risks including phishing, impersonation, account compromise, payment diversion, fraudulent wire instructions, and business email compromise.
- Members should independently verify any new or changed banking or wire instructions through a previously verified communication channel before transferring funds.
- Privé will never intentionally instruct a Member to disregard reasonable payment-verification procedures.
- To the fullest extent permitted by law, Privé is not responsible for losses resulting from a Member’s compromised account, third-party interception, fraudulent instructions, unauthorized access, or other cybercrime unless the loss is directly caused by Privé’s negligence, gross negligence, willful misconduct, or other liability that cannot legally be excluded, as applicable under governing law.
18. Supplier Insolvency & Financial Failure
- Privé does not guarantee the financial condition or continued operation of any independent supplier.
- Privé shall not be responsible for losses resulting from a supplier’s bankruptcy, insolvency, liquidation, cessation of operations, regulatory action, or other financial failure except to the extent otherwise required by applicable law.
- Where commercially reasonable, Privé may assist Members in pursuing available supplier refunds, insurance claims, chargeback documentation, replacement arrangements, or other available remedies.

- Privé is not required to disclose confidential supplier agreements or individual commercial arrangements except where disclosure is required by applicable law.
20. Events, Tickets & Experiences
- Tickets, reservations, experiences, and special-event access are subject to availability and the terms of the applicable venue, organizer, ticketing provider, or supplier.
- Event dates, locations, performers, participants, seating, access requirements, and schedules may change without notice.
- Privé cannot guarantee that an event or experience will occur as originally scheduled.
21. Wellness & Medical Services
- Privé may assist Members in identifying or coordinating wellness, health, fitness, recovery, or medical-related providers.
- Privé is not a healthcare provider and does not provide medical advice, diagnosis, or treatment.
- All healthcare and wellness decisions remain between the Member and the applicable licensed professional or provider.
22. Intellectual Property
- The Privé name, trademarks, logos, designs, website content, software, member materials, proprietary processes, proposals, presentations, itineraries, and other intellectual property are owned by or licensed to Privé.
- Nothing in these Terms grants a Member any ownership interest or license to use Privé intellectual property except as necessary for personal use of the Services.
- Privé intellectual property may not be copied, reproduced, distributed, commercially exploited, or used without prior written authorization.
23. Force Majeure
- Privé shall not be responsible for delays, interruptions, cancellations, or failures caused by circumstances beyond its reasonable control.
- Such circumstances may include severe weather, natural disasters, fires, pandemics, epidemics, war, terrorism, civil unrest, governmental actions, border closures, labor disputes, cyber incidents, infrastructure failures, supplier failures, transportation interruptions, or similar events.
- Privé will use commercially reasonable efforts to assist affected Members where practicable, but alternative arrangements and refunds remain subject to availability and applicable supplier terms.

- To the fullest extent permitted by applicable law, Privé shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost opportunities, loss of enjoyment, or damages resulting from the acts or omissions of independent suppliers.
- To the fullest extent permitted by applicable law, Privé’s aggregate liability arising from a specific transaction shall not exceed the amount of fees paid directly to Privé for the transaction giving rise to the claim.
- Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
25. Indemnification
- To the fullest extent permitted by law, Members agree to indemnify and hold harmless Privé and its applicable affiliates, officers, directors, employees, and representatives from third-party claims, liabilities, losses, damages, and reasonable expenses arising from the Member’s unlawful use of the Services, material breach of these Terms, fraud, willful misconduct, or violation of another party’s rights.
26. Governing Law
- These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable law requires otherwise.
27. Dispute Resolution & Arbitration
- Before commencing formal proceedings, the parties agree to make a good-faith effort to resolve disputes informally.
- If a dispute cannot be resolved, the parties agree to submit the matter to mediation and, if necessary, binding arbitration administered by the American Arbitration Association in Atlanta, Georgia, subject to applicable law.
- To the fullest extent permitted by law, disputes shall be pursued individually rather than through a class, collective, consolidated, or representative action.
- To the fullest extent permitted by law, the parties waive the right to a jury trial for disputes subject to binding arbitration.
